Truck Driver in Tracy Morgan Crash: The Media Ruined My Chances

The Wal-Mart worker wants criminal charges against him dismissed.

The Wal-Mart truck driver linked to Tracy Morgan's near-fatal car crash is asking for the criminal charges against him to be dismissed because he says the media made it impossible for him to get a fair trial.

According to People, Kevin Roper, who, back in August, was found responsible for the crash by the National Transportation Safety Board, has filed for a dismissal of the charges of assault by auto and death by auto, which he previously pleaded not guilty to. In the court documents, Roper, 35, argues that he won't get a "fair trial" or "impartial jury" because of the "extensive national media coverage" surrounding the incident.

"Mr. Roper had a right to have his case decided by a jury not a mob in the street fueled by media reports innuendo and speculation," his lawyer, David Jay Glassman, told ABC News in a statement.

After a fervent investigation, authorities determined that the Georgia native was suffering from fatigue, having not slept in 28 hours, but still decided to get behind the wheel of a Wal-Mart truck on June 7, 2014. His reported sleepiness resulted in him colliding with Morgan's limo at the New Jersey Turnpike, leaving the comedian critically injured and killing his friend and fellow comedian James "Uncle Jimmy Mack" McNair.
