Hinds County District Attorney Robert Smith upgraded the charges against 19-year-old  murder suspect Deryl Dedmon from murder to capital murder late Wednesday, making Dedmon now eligible for a possible death sentence if convicted.

Dedmon is being charged for his alleged involvement in the violent killing of a Black man in Jackson, Mississippi, earlier this summer.

The upgraded charge comes after new evidence was discovered suggesting that Dedmon also committed robbery during the killing of James Craig Anderson.

"It does not change the theory of the case," Smith told CNN. "It is still a hate crime.”
