LOS ANGELES – A white former transit officer sentenced to two years in prison for fatally shooting an unarmed black man wants to be free on bail while he appeals his conviction.
Attorneys for 28-year-old Johannes Mehserle will try to convince a Los Angeles judge Friday that the ex-Bay Area Rapid Transit officer should be released pending a challenge to his involuntary manslaughter conviction. Prosecutors are opposing the motion.
Mehserle was sentenced last month in the 2009 shooting of Oscar Grant on an Oakland train platform.
The trial was moved to Los Angeles because of intense media coverage and racial tensions.
With credit for time served, Mehserle could be eligible for release in about seven months.
