They noticed Mackie’s “watery eyes and the smell of booze.” He failed sobriety tests on the scene and declined a blood test when he was booked. His license was suspended immediately. Josh Brent - Drinking and driving could prove fatal in an emergency driving situation.Former Dallas Cowboys star Josh Brent was exceeding the speed limit on Jan. 7 in Irving, Texas, when his car, which had teammate Jerry Brown Jr. in the passenger seat, hit a curb. Brown was killed, and Brent was arrested for intoxicated manslaughter. Brent retired from the NFL in June. If convicted at his 2014 trial, he could face up to 20 years in prison.
