Dan Marino Files Concussion Lawsuit Against NFL

Hall of Fame quarterback among latest batch of former players suing the league.

Hall of Fame quarterback Dan Marino is one of 15 former NFL players to file the latest concussion-related lawsuit against the league.

According to USA Today, Marino and 14 ex-NFL players filed the lawsuit against the league in a federal court in Pennsylvania on May 28. They join the 4,500 players, who sued the NFL last year, accusing the league of misleading players about the long-term effects of concussions. The latter group of players agreed on a $765 million settlement with the NFL last August, but the settlement was rejected by a federal judge this past January.

According to the lawsuit documents obtained by USA Today, the suit filed by Marino and others is similar in nature to hundreds of earlier lawsuits, accusing the NFL of "carelessness, negligence, intentional misconduct" regarding concussions.

The plaintiffs are seeking money for medical treatment and compensation for long-term and chronic injuries, although the lawsuit doesn’t specify details about Marino’s current health.

Marino, 52, retired in 1999 after playing all 17 seasons with the Miami Dolphins. Unlike other quarterbacks such as Troy Aikman and Steve Young, Marino didn’t have a history of documented concussions, but did he deal with neck injuries late in his career. After his playing days he spent 2002-13 working as a studio analyst for CBS’s Sunday pre-game show, The NFL Today, before parting ways in February 2014.

In rejecting the $765 million settlement, federal judge Anita B. Brody wrote in a January statement, reported by USA Today, "Even if only 10 percent of retired NFL football players eventually receiving a qualifying diagnosis, it is difficult to see how the Monetary Award Fund would have the funds available over its lifespan to pay all claimants at these significant award levels."

Marino wasn’t immediately available for comment, according to USA Today.
