Colts Linebacker Josh McNary Charged With Rape

Indianapolis Colts linebacker Josh McNary has been charged with rape.

The Associated Press is reporting that prosecutors filed charges of rape, battery, and criminal confinement with bodily injury all stemming from a 29-year-old woman's accusation of an alleged assault against her during the morning hours of December 1.

Police determined the man was McNary after looking into a cellphone that the woman says she took from the man's apartment. McNary allegedly told police, "I know why you're here," when they arrived at his apartment. The police report also says that McNary alleged to have preserved evidence because he expected police to be investigating the alleged incident and complaint against him.

An attorney for McNary told the AP that his client "unhesitatingly" turned himself into Indianapolis law enforcement officials in a "respectful and peaceful manner" on Wednesday night. 

"The charges and affidavit publicly disseminated on Wednesday afternoon are not evidence of wrongdoing but simply one side's story," McNary's attorney Ed Schrager said. "Joshua has full confidence in the American way, including its justice system, which he pledged to protect and defend as a West Point graduate and lieutenant in the United States Army." 

The Colts also released this statement to the AP: "Unfortunately that's the limit of our knowledge. At this time we are very concerned and trying to find out what the relevant facts are, but we have insufficient information to venture any opinion. As we learn more we will make appropriate updates."

McNary, 26, has played for the Colts for two seasons. There hasn't been word on whether he'll play Sunday during the Colts' AFC title game against the New England Patriots
