Ray McDonald Indicted for Rape

San Francisco 49ers linebacker Ahmad Brooks also charged with sexual battery on alleged victim.

Ex-San Francisco 49ers defensive lineman Ray McDonald has been indicted on one count of raping an intoxicated woman.

ESPN is reporting that a Santa Clara County grand jury indicted McDonald on Wednesday, stemming from a December 15 incident at the former NFL player's home. Compounding the situation is current 49ers linebacker Ahmad Brooks has also been charged with misdemeanor sexual battery for an alleged assault on the same day with the same victim.

Upon learning the news, the 49ers sent Brooks home from Colorado, where the team was holding a joint practice with the Denver Broncos before their pre-season game Saturday night.

"The organization is aware that a misdemeanor charge has been filed against Ahmad Brooks stemming from a December 2014 matter. We take any charge against a member of this organization seriously and are in communication with the NFL. Ahmad is returning home to California and will not participate in Saturday's game," 49ers general manager Trent Baalke said in a statement released to the media, including ESPN.
McDonald is scheduled to be arraigned Sept. 25, facing a maximum of eight years in prison, while Brooks faces a maximum of six months in jail. His arraignment hadn't been scheduled as of yet.

The alleged victim filed a civil lawsuit against both men in May, claiming she had been drinking and Brooks groped her shortly after she slipped and fell on a pool deck at McDonald's home and went unconscious. She claims she was then carried by McDonald into his bedroom, where she was raped.

The 49ers released McDonald in December. The Chicago Bears gambled and signed him, only to release him in May following his second domestic violence arrest in less than a year.
