NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN
OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO, THE U.S. VIRGIN ISLANDS, AND OTHER COMMONWEALTHS, TERRITORIES AND POSSESSIONS), 21 YEARS OR OLDER.
1. ELIGIBILITY: This sweepstakes is open only to legal residents of the 50 United States and the District of Columbia (excluding Puerto Rico, the U.S. Virgin Islands, and other commonwealths, territories and possessions), 21 YEARS OR OLDER as of May 1, 2013. Employees, and their immediate families (spouses, parents, children, siblings, and their respective spouses), including household members of Black Entertainment Television LLC (the “Sponsor”), Coca-Cola North America, and their respective affiliates, subsidiaries, divisions, advertising and promotion agencies (collectively, the “Sweepstakes Entities”) are not eligible to enter. This sweepstakes is subject to all federal, state and local laws. By entering this sweepstakes, each entrant agrees to release and hold harmless Sweepstakes Entities and their respective parent companies, affiliates, subsidiaries, agencies, employees, officers, directors, representatives, and advertising and promotion agencies from any injury, loss, death, damage, action, claim, demand or other liability that may occur from entrant’s participation in this sweepstakes or from the acceptance or use of any prize awarded, or attendance at any event. Sponsor reserves the right to verify eligibility qualifications of any winner. U.S. law governs this sweepstakes. By entering, entrants agree to be bound by these Official Rules. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes.
2. HOW TO ENTER: This sweepstakes begins at 6:00 p.m. EDT May 1, 2013 and ends at 6:00 p.m. EDT May 14, 2013 (the “Entry Period”) and consists of four (4) phases.
Phase 1: During the Entry Period, log on to www.bet.com/ultimatefan and upload an original sixty second (00:60) video clip that creatively and convincingly represents why you are the ultimate fan of music and why you should be the lucky one to co-present the Coca-Cola Viewers’ Choice Award. Video clip should feature the entrant only and any third party trademarks, logos, store fronts, or music is prohibited.
Phase 2: On or about May 17, 2013, Sponsor will select twelve (12) potential semi-finalists (the “Semi-Finalists”) from amongst all eligible entries received during the Entry Period based on the originality, creativity, and entertainment value of their video clip.
Phase 3: The Semi-Finalists’ video clips will be posted on a BET.com voting page between May 28 and June 3, 2013 at which time users will vote for their favorite Semi-Finalist. The top three (3) Semi-Finalists with the most cumulative on-line votes will be selected as a finalist (the “Finalist”).
Phase 4: The Finalists will appear on a live taping of “106 & Park” during the week of June 17, 2013 to showcase their knowledge of music by participating in a variety of activities selected in Sponsor’s sole discretion. Viewers will text “A,” “B,” or “C” to 79922 to vote for their favorite Finalist. The Finalist with the most cumulative text votes will be selected as the Grand Prize Winner. Votes must be received by 7:30 p.m. EDT during the live taping of “106 & Park.”
Sweepstakes Entities assume no responsibility for any computer, technical, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, failures, connections, availability, or garbled or jumbled transmissions, or service provider/Internet/website/use net accessibility or availability, traffic congestion, or unauthorized human intervention. Sweepstakes Entities reserve the right to modify, suspend, or terminate the sweepstakes in whole or in part by giving such notice, in any form and manner deemed appropriate by Sweepstakes Entities. Should the sweepstakes be modified, suspended, or terminated as aforesaid, the Prize will nevertheless be awarded from amongst eligible entries previously received and in accordance with these Official Rules. Limit: One (1) entry per person.
3. CONDITIONS OF ENTRY: An eligible entry must be received as described above. Incomplete entries are void. By entering, entrants agree to the terms of the Video Submission Agreement on BET.com and with these Official Rules, including all eligibility requirements. To enter, your computer must accept cookies, or any successor or similar technology (now known or hereafter devised or discovered), which may be used by Sweepstakes Entities for the purposes of entry tracking and as set forth in BET.com’s Privacy Policy. Entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made. Sweepstakes Entities are not responsible or liable for lost, stolen, mutilated, incomplete, incorrect, delayed, late, interrupted illegible or misdirected entries. All entries become the property of Sweepstakes Entities and will not be acknowledged or returned.
In addition, by entering the Sweepstakes, entrant agrees to indemnify and hold the Sweepstakes Entities and their respective parent, subsidiaries, affiliates and their respective officers, directors, agents, licensees, advertising or promotion agencies, or other partners, and any of their employees (collectively the “Sweepstakes Indemnitees”) harmless from any and all claims, damages, expenses, costs (including reasonable attorney’s fees) and liabilities (including settlements), brought or asserted by any third party against the Sweepstakes Indemnitees arising out of or in connection with (a) any entry (including, but not limited to, any and all claims of third parties, whether or not groundless, based on the submission of such other material); (b) any breach by entrant of any warranty, agreement or representation contained in the Official Rules, the BET.com Terms of Use Agreement, the Submission Agreement, or in any documentation submitted by entrant; (c) the entrant’s conduct during and in connection with this sweepstakes, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation; or (d) the acceptance of any prize.
4. PRIZES: THREE (3) FINALISTS will each receive a 2 day/1 night trip for one (1) to the live taping of “106 & Park” during the week of June 17, 2013. The prize package includes (i) round-trip coach class airfare from the major gateway airport closest to the Finalist’s residence to New York, NY; (ii) hotel accommodations for one (1) night (one (1) single occupancy room selected solely by Sponsor, room and tax only); and (iii) round-trip ground transportation while in New York, NY to and from the hotel, airport, and taping. If the Finalist resides within the New York, NY area, he/she will receive round-trip ground transportation to and from his/her residence in lieu of round-trip coach class airfare. The approximate Total Retail Value is $1,500.00. Actual retail value will depend on the Finalist’s place of residence. Prize does not include any ground transportation to and from the Finalist’s residence and airport, meals, gratuities, ticket administrative fee and travel taxes, or any other expenses not specifically listed herein. Restrictions and blackout periods may apply to travel and hotel accommodations. If a Finalist cannot be available during the specified dates, prize will be forfeited and may be awarded to an alternate finalist. Any federal and state taxes on a prize are the sole responsibility of the Finalist. No substitution or transfer of prizes permitted, except at the sole discretion of Sponsor. If a prize is unavailable, Sponsor reserves the right to substitute a prize of equal or greater value. Prize package has no cash redemption value and must be taken during the week of June 17, 2013. Winner will be responsible for any change fees associated with changes to the itinerary once booked by Sponsor.
ONE (1) GRAND PRIZE WINNER will receive a 5 day/4 night trip for two (2) to the “BET Awards” scheduled June 30, 2013 in Los Angeles, California for an opportunity to co-present the Coca-Cola Viewers’ Choice Award. The prize package includes (i) round-trip coach class airfare from the major gateway airport closest to the Grand Prize Winner’s residence to Los Angeles; (ii) two (2) tickets to the “BET Awards;” (iii) hotel accommodations for four (4) nights (one (1) double occupancy room selected solely by Sponsor, room and tax only); (iv) round-trip ground transportation while in Los Angeles, CA to and from the hotel, airport, and taping; (v) One Thousand Dollars ($1,000.00) in the form of a pre-paid credit card; and (vi) one (1) video-enabled device that must be used to capture the Grand Prize Winner’s experience leading up to and during the “BET Awards” (“Footage”). Footage, which shall be at all times the sole and exclusive property of BET, must be submitted to Sponsor upon request and may be used and exploited by the Sweepstakes Entities in any media now known or hereafter devised in any manner whatsoever in perpetuity throughout the world including, but not limited to, television transmission and the Internet. The Grand Prize Winner acknowledges and agrees that he/she has no claim whatsoever to the use or exploitation of the Footage or the results or proceeds or any derivative thereof by or through any media now known or hereafter devised in any manner whatsoever. If the Grand Prize Winner resides within the Los Angeles area, he/she will receive round-trip ground transportation to and from his/her residence in lieu of round-trip coach class airfare (collectively, the “Prize”). The approximate Retail Value is $5,500.00. The actual retail value will depend on the Grand Prize Winner’s place of residence. Prize does not include any ground transportation to and from the Grand Prize Winner’s or his/her travel companion’s residence and airport, meals, gratuities, ticket administrative fee and travel taxes, or any other expenses not specifically listed herein. Restrictions and blackout periods may apply to travel and hotel accommodations. Prize package has no cash redemption value and must be taken during the period June 27 – July 1, 2013. The Grand Prize Winner and travel companion (who must be twenty-one (21) years of age or older at the time of travel) must travel on the same itinerary. If the Grand Prize Winner cannot be available on the specified dates, prize will be forfeited and may be awarded to an alternate grand prize winner. Any federal and state taxes on a prize are the sole responsibility of the Grand Prize Winner. All winners will be required to provide his/her social security number for tax purposes and will be issued a 1099 at the end of the year. No substitution or transfer of prizes permitted, except at the sole discretion of Sponsor. If a prize is unavailable, Sponsor reserves the right to substitute a prize of equal or greater value. All prizes will be awarded provided they are properly claimed.
All aspects of the travel portions of the Grand Prize and Prize must be conducted on such dates as determined by Sponsor in its sole discretion. The dates of departure and return are subject to change at Sponsor’s sole discretion. Airfare may not include government taxes, Passenger Facility Charge or September 11th Security Fee. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes. Sponsor reserves the right to structure travel routes and select hotels in its sole discretion. The ARV for travel prizes is an estimate made before the Sweepstakes begins. The winners will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The round trip air transportation element for any travel prize begins and ends at the point of departure. No interest will be awarded on cash prizes. Room taxes and other hotel fees are not included and if applicable may be payable at the time of check-out by the winner/travel companion. A deposit or payment in advance, or presentation of a credit card by the winners, may be required at the time of check-in at the hotel. Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly. The Grand Prize and Prize restrictions/conditions stated herein are not all-inclusive and either or both may be subject to additional restrictions/conditions, which may be stated in the “Prize Claim Documents” (as defined below) and/or other travel documents. In the event the winners and/or his or her travel companion engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send such winner and/or his or her travel companion home with no further compensation. Gift cards are subject to the terms and conditions of the issuer.
5. DETERMINATION OF WINNER: Twelve (12) potential Semi-Finalists will be selected by Sponsor on or about May 17, 2013 based on the originality, creativity, and entertainment value of their video clip from amongst all eligible entries received during the Entry Period. The Semi-Finalists’ video clips will be posted on the “BET Awards” microsite between May 28 and June 3, 2013 for users to vote for their favorite Semi-Finalist. The top three (3) Semi-Finalists with the most cumulative on-line votes will be selected as a Finalist. The Finalists will appear on “106 & Park” during the week of June 17, 2013 to showcase their music knowledge by participating in a variety of activities selected in Sponsor’s sole discretion. Viewers will text “A,” “B,” or “C” to 79922 to vote for their favorite Finalist. The Finalist with the most cumulative text votes will be selected as the Grand Prize Winner. Votes must be received by 7:30 p.m. EDT during the live taping of “106 & Park.” The voting process shall be conducted under the supervision of Sponsor. Sponsor shall choose the winners in its sole discretion. Sponsor will notify the potential winners by phone and/or e-mail.
6. GENERAL CONDITIONS: The potential Semi-Finalists and Grand Prize Winner’s travel companion will be required to sign and return an Affidavit of Liability and Publicity Release and any other documents sent by Sponsor within three (3) days of notification. Failure to return the documents as specified, if unavailable to travel during the specified timeframe, or if prize notification is returned as undeliverable will result in the entry being disqualified, and an alternate potential semi-finalist may be selected. Where permitted by law, winners agree to grant to Sweepstakes Entities and Sweepstakes Entities’ licensees, affiliates and assigns, the right to print, publish, broadcast and use, worldwide, in any media now known or hereafter developed, including but not limited to the world wide web, at any time, the Semi-Finalists’ video clip, name, pictures, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, appear for, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews as may be determined by Sweepstakes Entities. Failure to make such appearances or grant such rights may result in disqualification and an alternate semi-finalist may be selected; and while not obligated to do so, Sweepstakes Entities may in their sole discretion, bear such reasonable costs and expenses which Sweepstakes Entities, in their sole discretion, deem appropriate for the winner to appear for a presentation or other activity. Further, by accepting a prize, the winner agrees to release and hold harmless Sweepstakes Entities and their parent, subsidiaries, licensees, affiliates, subsidiaries, advertising and promotion agencies, and their respective directors, officers, employees, representatives, and agents from any and all liability for any injuries, loss, or damage of any kind to person, including death, and property arising whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, the travel or participation in all BET-affiliated events, participation in any sweepstakes related activity, or participation in this sweepstakes. Odds of winning depend on the number of eligible entries received. IN NO EVENT WILL SWEEPSTAKES ENTITIES AND THEIR PARENT, SUBSIDIARY, LICENSEES, AND OR AFFILIATES AND RELATED COMPANIES, THEIR SPONSORS, ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO USE OF INTERNET SITE www.BET.COM OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. Sponsor reserves the right, in its sole discretion, to disqualify any individual they find, in their sole discretion, to be tampering with the entry process or the operation of the sweepstakes or website; to be in violation of the Terms of Service of Sponsor’s web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, or like entry methods will void all such entries by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the sweepstakes at the actual time of the entry will be deemed to be the entrant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization, which is responsible for assigning email addresses email, addresses or the domain associated with the submitted e-mail address.
7. DISPUTES: As a condition of participating in this sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the State of New York having competent jurisdiction, which Court shall apply the laws of the State of New York without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and entrant further waives all rights to have damages multiplied or increased.
8. PRIVACY: By use of the Sweepstakes website or by entering the Promotion through the Sponsor’s website, you agree to the Sponsor’s Terms of Use Agreement located at http://www.bet.com/terms-of-use.html and to the use of your personal information as described in Sponsor’s Privacy Policy located at http://www.bet.com/privacy-policy.html.
9. WINNERS’ LIST: For the name of the Grand Prize Winner, available after June 27, 2013, mail a self-addressed stamped envelope to: “Coca-Cola and BET Awards Ultimate Fan Sweepstakes” to Black Entertainment Television LLC, One BET Plaza, 1235 “W” Street, NE, Washington, D.C. 20018. Washington and Vermont residents may omit return postage when requesting list of prize winners.
