NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.
OPEN TO AMATEURS ONLY WHO ARE LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO, THE U.S. VIRGIN ISLANDS, AND OTHER U.S. COMMONWEALTHS, TERRITORIES AND POSSESSIONS), 18 YEARS OR OLDER.
ELIGIBILITY: This contest (the “Contest”) is open to amateurs only who are legal residents of the 50 United States and the District of Columbia (excluding Puerto Rico, the U.S. Virgin Islands, and other commonwealths, territories and possessions), 18 YEARS OR OLDER and not considered a minor in their state of residence at the time of entry. Employees, and their immediate families (spouses, parents, children, siblings, and their respective spouses), including household members of Black Entertainment Television LLC (“BET”), 135th St. Agency (collectively, the “Producer”), and their respective parent companies, affiliates, subsidiaries, agencies, employees, officers, directors, representatives, divisions, advertising and promotion agencies or any person or entity connected with the production, administration or judging of the Contest (collectively, the “Released Parties”) are not eligible to enter. By entering this Contest, each entrant (the “Entrant”) agrees to release and hold harmless the Released Parties from any injury, loss, death, damage, action, claim, demand or other liability that may occur from Entrant’s participation in this Contest and/or the Program (defined below) (including attendance at any Contest or Program-related event or activity) or from the acceptance, use or misuse of any prize awarded. Producer reserves the right to verify eligibility qualifications of any winner. U.S. law governs this contest. Producer further reserves the right, in their sole discretion, to modify these rules as necessary. By entering, Entrants agree to be bound by these Official Rules. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Producer is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes.
HOW TO ENTER: This Contest begins at 6:00 p.m. EDT March 18, 2013 and ends at 12:00 a.m. EDT March 23, 2013 (the “Contest Period”). Entrants may enter the Contest via either of the following entry methods:
- ONLINE: Log on to www.bet.com/gamesuperfan (the “Website”) and upload an original video (the “Video”) that clearly illustrates why you are the “Ultimate Fan” of BET’s program entitled, “The Game.” The Video must adhere to the following guidelines:
- Must be 100% original created solely by the Entrant and must not infringe upon any third party rights;
- Must feature the Entrant only;
- Must not contain any background music or third party material (e.g., names, trademarks or logos);
- Must be a maximum of three minutes (3:00) in length, maximum 20MB, and in one of the following file formats (.mov, .wmv, .mpg, .mpeg, and .mp4);
- Must not contain any content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, or that otherwise is deemed inappropriate or objectionable determined in Producer’s sole discretion; and
- Must clearly illustrate Entrant’s knowledge of the past five (5) seasons of “The Game.”
Producer assumes no responsibility for any computer, telephone, cable, network, satellite, mail, electronic or Internet hardware or software malfunctions, failures, connections, availability, or garbled or jumbled transmissions, or service provider/Internet/website/use net accessibility or availability, traffic congestion, or unauthorized human intervention. The Producer reserves the right to modify, suspend, or terminate the Contest in whole or in part by giving such notice, in any form and manner deemed appropriate by the Producer. Should the Contest be modified, suspended or terminated as aforesaid, the Prize (defined below) will nevertheless be awarded from among all eligible entries received prior to (or after, if applicable) the modification, suspension or termination and in accordance with these Official Rules.
By entering this Contest, Entrants hereby agree to the terms of BET’s Video Submission Policy located at http://www.bet.com/submission-agreement.html, the Official Rules, Non-Disclosure Agreement, and Appearance Release. Further, Entrants agree that Producer reserves the right to edit the Video for any reason, including network standards and practices purposes.
- AUDITIONS: Log on to www.bet.com/gamesuperfan to download the Non-Disclosure Agreement, Appearance Release, and any other required documents and for the most up-to-date information pertaining to the Contest, including, but not limited to, audition locations (the “Location(s)”), dates, and times. Auditions are scheduled to be held at the following Locations and are subject to change.

Entrants will be seen on a first-come, first-served basis and must arrive camera ready. The Producer will only see the first two hundred (200) Entrants at each audition Location, but hereby reserves the right modify this commitment based on time constraints or otherwise, without limitation. Entrants must arrive to the audition Location two (2) hours prior to closing time and must not arrive two (2) hours prior to start time. The Producer shall not be liable for any loss, damage, or otherwise arising out of connection with Entrant’s early arrival to a Location. The Producer reserves the right in its sole discretion to refuse any Entrant from auditioning. Entrants must bring a fully completed Non-Disclosure Agreement, Appearance Release, and any other required documents, along with a government-issued photo identification (e.g., passport or driver’s license). Failure to bring the foregoing documents, will result in disqualification and the Entrant will not be allowed to audition. The Producer will photograph and film all Entrants as they go through the audition process, including registration. As a result, Entrants must refrain from wearing any clothing or apparel which may contain any (1) proprietary material (e.g., logos or trademarks); (2) personally identifiable information (e.g., full name, e-mail address or website); or (3) derogatory material (e.g., slang, profanity or gang signs). The Producer reserves the right in its sole discretion to cover the foregoing clothing or apparel or request an Entrant to change for any reason.
Once the registration process is completed and all required paperwork has been received by the Producer, each Entrant will receive an Identification Number and will be escorted to the audition room where they will await the opportunity to perform for up to two minutes (2:00) in front of a panel of judges (the “Judges”) selected in the Producer’s sole discretion. Each Entrant must adhere to the following guidelines:
- Material must be 100% original created solely by the Entrant and must not infringe upon any third party rights;
- Must feature the Entrant only;
- Must not contain any background music or third party material (e.g., names, trademarks or logos);
- Must be a maximum of three minutes (3:00) in length;
- Must not contain any content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, or that otherwise is deemed inappropriate or objectionable determined in Producer’s sole discretion; and
- Must clearly illustrate Entrant’s knowledge of the past five (5) seasons of “The Game.”
Notwithstanding the foregoing, the Judges will have full discretion to determine the length of each Entrant’s audition. At any time during each Entrant’s audition, the Judges may elect to dismiss the Entrant from the audition process, request the Entrant to continue with their audition, request the Entrant to start over or require the Entrant to wait until the Judges provide further notice. Once the Entrant has auditioned, he/she should immediately gather their belongings and depart from the Location, unless directed otherwise by the Producer. The potential Winner will not be determined, announced, or finalized at any of the Locations. No matter what the Producers or Judges verbally tell the Entrants during the auditions, he/she has not been selected as a potential Winner until the Producer and the Judges have reviewed all eligible entries received during the Contest Period.
CONDITIONS OF ENTRY: Limit: One (1) entry per person. An eligible entry must be received as described above. Incomplete entries are void. By entering, Entrants agree to comply with these Official Rules, including all eligibility requirements. Your e-mail address may be used by the Released Parties for the purposes of entry tracking and as set forth in BET.com’s Privacy Policy. Your computer must accept cookies, or any successor or similar technology (now known or hereafter devised or discovered), which may be used by the Released Parties for the purposes of entry tracking and as set forth in BET’s Privacy Policy. Entry will be deemed to have been submitted by the authorized account holder of the e-mail address from which the entry is made. The Released Parties are not responsible or liable for lost, stolen, mutilated, incomplete, incorrect, delayed, late, interrupted illegible or misdirected entries. All entries become the property of the Released Parties and will not be acknowledged or returned.
PRIZE: One (1) winner (the “Winner”) will receive the opportunity to become “The Game Superfan” and host the new BET webchat entitled, “Sideline Wrap-Up” (the “Program”), a post-show wrap-up all about “The Game” and each episode’s events (the “Prize”). The Prize package includes (i) one (1) Two Thousand Five Hundred Dollar ($2,500.00) check and (ii) ground transportation to and from the Winner’s residence and each Program taping, which schedule is to be determined by Producer in its sole discretion. The approximate retail value for the Prize is $3,500.00. The actual retail value depends on the Winner’s place of residence. The Prize does not include any other expenses not specified herein. Travel times, dates, and accommodations are subject to availability and scheduling; certain restrictions and blackout dates may apply. The Prize package has no cash redemption value. The Winner must be available beginning March 25, 2013 for the production and promotion of the Program. If the Winner is unavailable to travel on the specified dates, the Prize will be forfeited and may be awarded to an alternate winner. Any federal and state taxes on the Prize are the sole responsibility of the Winner. The Winner will be required to provide his/her social security number for tax purposes and will be issued a 1099 at the end of the year. No substitution or transfer of prizes permitted, except at the sole discretion of the Released Parties. If a prize is unavailable, the Released Parties reserve the right to substitute a prize of equal or greater value. The Prize will be awarded provided it is properly claimed and is non-assignable and non-transferable.
DETERMINATION OF WINNER: One (1) potential Winner will be selected by the Producer on or about March 25, 2013 from among all eligible entries received online and at the audition Locations during the Contest Period based on (i) Entrant’s obsession with “The Game,” (ii) Entrant’s knowledge about the past five (5) seasons of “The Game,” and (iii) Entrant’s overall on-screen presence and presentation. The Winner will be announced on BET’s “106 & Park” on or about March 25, 2013. The selection process shall be conducted under the supervision of Producer and in consultation with the Judges. The Producer shall select the Winner in its sole discretion whose decision is final and binding. Producer will notify the potential Winner by phone and/or e-mail using the contact information provided at the time of entry on or about March 25, 2013. Producer shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential prize winner does not respond within twenty-four (24) hours of the first notification attempt, or if a prize or prize notification is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner will forfeit the applicable prize and an alternate prize winner may be selected. If any potential prize winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the applicable prize for any reason prior to award, such potential prize winner will be disqualified and an alternate winner may be selected. Producer may successively attempt to contact up to two (2) potential prize winners in accordance with such procedure, and if there is still no confirmed prize winner after such attempts have been made, if any, the applicable prize may go unawarded.
GENERAL CONDITIONS: In addition to any other previously required documents, the Winner will be required to sign and return an Affidavit of Liability and Publicity Release and any other required documents within twenty-four (24) hours of notification. Failure to return these documents, or if prize notification is returned as undeliverable will result in forfeiture or delayed processing of the Prize. The Entrants and the Winner agree to grant to the Released Parties and Released Parties’ licensees, affiliates and assigns, the right to print, publish, broadcast and use, worldwide, in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, their audition, name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration; and further without such additional compensation, appear for, or provide biographical information for use in, any presentation or other activity which may include filming/audio/video/electronic or other recordings and/or interviews as may be determined by the Released Parties. Failure to make such appearances or grant such rights may result in disqualification and an alternate winner may be selected; and while not obligated to do so, the Released Parties may in their sole discretion, bear such reasonable costs and expenses which the Released Parties, in their sole discretion, deem appropriate for the Winner to appear for a presentation or other activity. Further, by accepting the Prize, the Winner agrees to release and hold harmless the Released Parties, and their parent, subsidiaries, licensees, affiliates, subsidiaries, advertising and promotion agencies, and their respective directors, officers, employees, representatives, and agents from any and all liability for any injuries, loss, or damage of any kind to person, including death, and property arising whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Contest or Program-related activity, or participation in this Contest and/or Program. Odds of winning depend on the number of eligible entries received during the Contest Period. IN NO EVENT WILL THE RELEASED PARTIES, THEIR PARENT, SUBSIDIARY, LICENSEES, AND OR AFFILIATES AND RELATED COMPANIES, THEIR RELEASED PARTIES, ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO USE OF INTERNET SITE www.BET.COM OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS, OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS, FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
The Producer reserves the right, in its sole discretion, to disqualify any individual they find, in its sole discretion, to be tampering with the process or operation of the Competition, Program, or Website; to be in violation of the Terms of Service of BET’s web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed, or like entry methods will void all such entries by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the Contest at the actual time of the entry will be deemed to be the participant and must comply with these rules. Authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization, which is responsible for assigning email addresses email, addresses or the domain associated with the submitted e-mail address.
DISPUTES: As a condition of participating in this Contest, Entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest or the Program, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the State of New York having competent jurisdiction, which Court shall apply the laws of the State of New York without regard for doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other than entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and Entrant further waives all rights to have damages multiplied or increased.
PUBLICITY: All publicity, paid advertisements, press notices, interviews and other information with respect to the Contest shall be under Producer’s sole control and all information pertaining to the Contest, Entrant’s duties and obligations pursuant to these Official Rules, the terms of these Rules and all business and activities of Producer, Released Parties their related and affiliated entities and all of its employees and agents, shall be kept strictly confidential by Entrant and Entrant shall not issue nor consent to, nor authorize any person or entity to release any such information without Producer’s express prior written approval in each instance. Under no circumstances shall Entrant, or any person or entity on Entrant’s behalf use or employ any of the names, marks or logos of BET or any other BET Networks or Viacom entity for any purpose with the prior, express, written permission of BET Networks.
WINNER’S LIST: For the name of the winner, available after March 26, 2013, mail a self-addressed stamped envelope to “Sideline Wrap-Up Superfan Contest” to Black Entertainment Television LLC, One BET Plaza, 1235 “W” Street, NE, Washington, D.C. 20018. Washington and Vermont residents may omit return postage when requesting the name of the winner.
