Roy Middleton, a 60-year-old man, was shot by police in his mother’s driveway in Florida this weekend. Middleton, who was unarmed, was attempting to grab cigarettes from the car when he was shot at by Escambia County deputies.

The officers were responding to a neighbor who called the police at 2 a.m. because he suspected that Middleton was attempting to steal the car.

The police ordered Middleton to “get your hands where I can see them,” but according to Pensacola News Journal, Middleton said he thought it was a neighbor joking with him until he turned his head and saw the deputies standing in his driveway.

Upon seeing the officers, he backed out of the vehicle with his hands raised, but when he turned to face the deputies, they immediately opened fire, Middleton told the Pensacola News Journal.

The deputies reportedly fired seven shots at Middleton. He was shot in the leg and another five bullets hit the car and the side of a house.
