The baby suffered nerve damage during birth.

A family in Nevada has been dealing with unfathomable hardships since their son was born last year.

Almost a year and a half since her son Jared was born, Alex Sims has now filed a lawsuit claiming that the doctor who delivered her son is at fault for the child's health ailments, and she has the video footage to prove it. 

As reported, Sims was in induced labor in May of 2015 when her doctor, Dr. Frank DeLee, openly talked about drinking prior to delivering her baby boy. Sims is claiming that DeLee's careless delivery caused him to suffer from paralysis to his arm due to nerve damage, also known as Erb's Palsy.

During the mom-to-be's interactions with Dr. DeLee, her family recorded the birth and the footage reveals that he can be heard saying, "Wasn't that many people in the bar when I left."

The nurse then entertains him asking, "I'm sorry. Did you waste a drink?"

According to the report, DeLee was on vacation at the time but was on-call, which is why he ended up delivering Sims' child. In the footage, the doctor can be seen wearing a pair of Bermuda shorts and can be seen standing in the hospital room barefoot.

On top of the shocking unprofessionalism, DeLee can also be heard in the video saying, "Don't you wish Richter stayed in town this weekend now?" referring to the woman's original birth plan and doctor.

Sims' mother, Sheree, also is claiming that she could smell alcohol as soon as the doctor walked in the room.

Sims also shared that she doesn't "understand why he still has a license to practice," with the doctor having reports of other possible malpractice in his history. According to the report, his past insurance payouts and settlements have totaled more than $2.7 million.

Court documents state that DeLee denies any liability or wrongdoing when it comes to the birth of Jared and the doctor's actions.
