A father is trying to turn a tragic loss into a movement for stricter DUI laws in California.
Zach Kincaid posted photos from the funeral of his wife and unborn child on social media. They were from a September 26 gathering at McWane Family Funeral Home showing his 29-year-old wife, Krystil Kincaid and the daughter they planned to name Avalynn Onix in a casket.
“A drunk driver speeding down a two lane highway at 85+mph in the wrong lane around a blind corner destroyed my family,” he captioned in his post. “The max sentence for killing my wife and daughter is 10 years max. The state of California doesn't think there was intent, but I know driving recklessly in that manner, he didn't intend anything good.... my daughter's due date was October 9th, a 36 week old fully developed baby isnt considered a person in the state of California.”
Marcos Forestal, a former boxing champion, was the alleged driver who killed the two in the accident. According to Kincaid, he won’t face as many years for taking his daughter’s life because she wasn’t developed enough. Forestal has been charged with gross vehicular manslaughter while intoxicated and held on $75,000 bail. He sustained minor injuries.
Kincaid also has an 11-year-old daughter and two younger sons who will no longer have a mother or be expecting another sibling.
