Child Pornography Found on D4vd's iPhone Is Key Evidence in Murder Case, Prosecutors Reveal

Los Angeles prosecutors said they have 40 terabytes of digital evidence against the singer, including a 'significant amount' of child sexual abuse material.

Child sexual abuse material recovered from D4vd's iPhone is among the key evidence Los Angeles County prosecutors say they will present against the singer, who stands accused of killing and dismembering 14-year-old Celeste Rivas Hernandez.

At a hearing Thursday morning — one year to the day after Celeste was last seen alive going to D4vd's Hollywood Hills home — Los Angeles County Deputy District Attorney Beth Silverman told a judge that evidence against the singer includes "a significant amount of child pornography" on his iPhone, as well as a wiretap and up to 40 terabytes of data obtained by law enforcement, per CNN. According to CBS News Los Angeles, the CSAM was recovered from Burke's iCloud account.

"We're eager to set a trial date," Silverman said in court. Under California law, child pornography evidence can't be obtained without following a specific court protocol, she noted. The DA's office has begun handing over investigative findings to D4vd's defense team, which said Monday they had received "almost no discovery" related to the case. The preliminary hearing — at which a judge will determine whether there is sufficient evidence to move forward with trial — was postponed to May 1 at the defense's request.

The Autopsy

The Los Angeles County Medical Examiner's autopsy report, released Wednesday after being sealed at law enforcement's request since December, details the physical horror of what happened to Celeste. She died of "multiple penetrating injuries" consistent with stabbing. Wounds on her chest and abdomen "may represent sharp force injuries." Her arms and legs were severed. Two fingers on her left hand had been removed. Blue plastic fragments were "embedded in the cut surfaces" of her remains, according to the report.

A tattoo reading "Shhh…." was found on the inside of her right index finger — similar to a tattoo D4vd has on his own finger.

"It looks like likely a knife made the wounds," Dr. Priya Banerjee, a board-certified forensic pathologist not involved in the case, told CNN after reviewing the public report. The medical examiner's report confirmed Celeste was likely dismembered after she died.

D4vd, whose legal name is David Anthony Burke, has pleaded not guilty to first-degree murder with special circumstances, continuous sexual abuse of a child under 14, and mutilating human remains. The special circumstances — lying in wait, murder for financial gain, and murdering a witness in an ongoing investigation — make the case eligible for the death penalty or life without parole. As BET.com previously reported, prosecutors allege Burke killed Celeste with a "sharp instrument" on April 23, 2025, to keep her from exposing a sexual relationship that began when she was 13 and that threatened his career.

Defense attorney Blair Berk has maintained Burke's innocence. "The actual evidence in this case will show that David Burke did not murder Celeste Rivas Hernandez and he was not the cause of her death," she said in a statement. "We will vigorously defend David's innocence."

Burke, dressed in a bright orange jumpsuit at Thursday's hearing, appeared in court in leg and arm shackles that were removed by a deputy after he was seated. He is being held without bail. Celeste's family attorney Patrick Steinfeld told CNN they were "overwhelmed and devastated" by the details revealed in court. Burke is presumed innocent unless convicted.
