Anthony Mackie Fights DUI Arrest

Captain America star says that cops had no right to arrest him following the 2013 incident.

Actor Anthony Mackie, 36, is currently fighting a 2013 DUI arrest, arguing during his trial in Manhattan Criminal Court that police had no right to arrest him.


According to Page Six, the action star, who plays Falcon in Marvel's Captain America franchise, argued there was no justification for his arrest. Speaking on his behalf, Mackie's attorney, Mike Miller, said, "It's clear that the mere smell of alcohol and bloodshot eyes doesn't give the officers justification to arrest him."

Mackie was pulled over in Harlem in November 2013, after cops spotted the tinted windows on his Dodge Challenger. Upon further inspection, police claimed that the actor had bloodshot eyes and the smell of alcohol on his breath. Further suspicions were made when he refused the breathalyzer test.
